Important Information About NFA Injunction Eligibility
We occasionally receive questions regarding the current federal court injunction affecting certain National Firearms Act (NFA) requirements for suppressors and other affected firearms. Based on publicly available analyses of the court's ruling in the consolidated cases Silencer Shop Foundation v. ATF and Jensen v. ATF, the injunction is generally described as a party-specific injunction, not a nationwide repeal or suspension of the National Firearms Act. The court reportedly declined to issue universal relief and instead limited the injunction's protection to specified plaintiffs, members, customers, and other covered parties identified in the litigation. [russrobylaw.com], [selfdefensefund.net], [arms-eng.com] As a result, simply believing that the injunction applies to everyone is not, by itself, sufficient documentation for a transfer. Public legal commentary regarding the ruling consistently states that a person seeking to rely on the injunction should be able to identify the specific basis upon which they are covered. What This Means
- The existence of the injunction does not automatically establish that every customer is covered. [russrobylaw.com], [selfdefensefund.net]
- Various legal analyses state that coverage may depend upon a customer's status as a plaintiff, member, customer, governmental entity, or other specifically covered party identified in the litigation. [selfdefensefund.net], [arms-eng.com]
- Virginia is not identified as one of the plaintiff states discussed in available analyses. [selfdefensefund.net]
- GFR LLC reserves the right to request supporting documentation before relying upon any claimed injunction coverage.
